Fried is Right
Check out this piece from my former Jurisprudence professor, Charles Fried.
Although he takes the obligatory (though still unjust" swipe at the religious right, for the most part, he cogently argues that history, tradition and even the Constitution favor the GOP's side of the filibuster argument.

Fried does NOT argue that "history, tradition and even the Constitution favor the GOP's side of the filibuster argument".
Fried is arguing that the law and Constitution do not compel a particular outcome with respect to filibustering of judicial nominations.
Fried basical says that this is a political fight, however either side might wish to couch its rhetoric.
